Poland, acting pursuant to Art. 14 sec. 2 of Regulation (EC) No 561/2006 decided to introduce temporary derogations from the application of the provisions of Art. 6 sec. 1-3, art. 7 and art. 8 sec. 8 above regulations on driving times, breaks and rest periods for drivers.
The derogations will apply from March 4 to April 2, 2022.
According to the accepted exceptions:
- the daily driving time must not exceed 11 hours (derogation from Article 6 (1)),
- the weekly driving time must not exceed 60 hours (derogation from Art.6 (2)),
- the total driving time for the two consecutive weeks must not exceed 96 hours (derogation from Article 6 (3)),
- after a driving period of 5.5 hours, the driver is allowed a continuous break of at least forty-five minutes (derogation from Article 7),
- the driver may, if so choose, also take a regular weekly rest period in the vehicle, as long as he has suitable sleeping facilities for each driver and the vehicle is stationary (derogation from Article 8 (8)).
The drivers referred to above are required to indicate by hand on the back of the analog tachograph record sheet or the digital tachograph printout the reasons for using the deviations referred to above. This is normal practice in an emergency and is essential for the control of the abovementioned regulations.
The application of the above-mentioned temporary derogations may not deteriorate the working conditions of drivers and the level of road safety. It should therefore not be possible for a driver to drive a vehicle when he is tired - employers remain responsible for the health and safety of their employees as well as other road users. Transport entrepreneurs at this particular time will exercise due diligence in planning and managing the risk of disruptions in the supply chains.
